After a SD incident, you stay silent, but your partner?

Have never seen this question addressed. You were forced to defend yourself. No, you don’t talk to police without an attorney, but what about your spouse / significant other / sibling / friend who was present?

They are your witnesses. As long as they don’t say you are guilty you should be good.

Interesting thought.

I suppose it would depend on how strong your relationship is with that person.

Does that person secretly plan your death so they can collect the insurance money? If that answer is “Yes” they might not be the best one to have in your corner.

Does that person love and trust you unconditionally and back you up in every situation - good, bad or indifferent? Again, if that answer is “Yes” they might not be the best one to have in your corner either because they might end up in the next cell.

In a perfect world, we would all need Jiminy Cricket at our sides in an SD incident. My Wife is my Jiminy Cricket, although she is much better looking and can cook. She also knows if push comes to shove the other person or persons involved will be going home in body bags and I will have a new pair of bracelets. She knows to call LE, get them coming, hang up, then call USCCA. She, like me, will not talk to LE without a lawyer present.

That’s good, up to the point she gets charged with obstruction for not making a statement.

Honestly, it’s a double edged sword.

Anything you (or they) say can and will be used against you in a court of law.

A good witness statement on scene could help lessen charges or harsh treatment in the moment? :man_shrugging:.
Possibly be of assistance later down the line as well?

Like me, she has the right to request a lawyer. She can make her statement with a lawyer present and there is no obstruction. She may get detained until the lawyer gets there, but she will not be arrested.

Been there, Done that. Not with this Wife.

Had this conversation to many times to count with my SO. Call 911 get them coming, hang up and call the USSCA.

If they are witnesses and not participants? They can most definitely refuse to talk to the cops until they’ve talked to a lawyer, specifically your USCCA or other lawyers. Once again, THE COPS AREN”T YOUR FRIENDS, they are witnesses for the prosecution.

My understanding is that if this gets to court, they cannot force your spouse to testify.

The proper response as stated above is, I will be happy to cooperate and provide a statement with my attorney’s involvement.

The next thing my wife will say is that she has just experienced a traumatic event, doesn’t feel well, and needs medical attention. That will absolutely be true. Then let the EMT’s take over and likely take her away to the hospital to be fully evaluated. That will buy some time to get settled.

I want them to consult a lawyer but yet, I want them to tell the truth from what they saw. Everyone’s perspective is different. Could it screw you? Sure but I dont want anyone to sell out there morale for me.

Something about this reminds me of that classic Chris Rock PSA. The whole thing is worth watching, but I think this part is relevant here: “If your woman is mad at you, leave her at home.”
